Terms of Service

1. Parties, business scope and authority

These Terms are between Punasaari Research · Y-tunnus 3580452-7 · Varistonkuja 2, 01660 Vantaa, Finland (“Somemind”, “we”) and the business customer using the service (“Customer”, “you”). Somemind is offered for business and professional use. By registering, the person acting for the Customer confirms that they are at least 18 and authorized to bind that business.

2. Service and platform scope

Somemind analyzes permitted trend signals, national-calendar events, brand information and performance data to plan, generate, review, schedule and publish social media content. AI output and automation require customer configuration and may need review.

Current publishing integrations cover Facebook Pages, Instagram professional accounts and TikTok accounts. Platform availability, analytics and delivery depend on third-party permissions, account type, API status and policies. LinkedIn, YouTube, Pinterest and X may be described as coming soon and have no promised delivery date.

3. Accounts and customer responsibilities

The Customer must provide accurate account, company and billing details, protect credentials, connect only accounts it is authorized to manage, configure automation responsibly and comply with applicable law, intellectual-property rights, advertising rules and platform policies. The Customer remains the publisher of content sent through its accounts.

4. Seven-day Stripe Starter trial

A public trial is available only to eligible first-time customers using a valid Starter trial code. It lasts exactly seven days and requires a valid payment method in Stripe Checkout.

Before starting, Checkout shows the selected monthly or annual recurring Starter price and expected first-charge date. Unless cancelled before the trial ends, Stripe automatically charges the stored payment method and the subscription continues at the selected interval.

A code may be limited by customer, expiry, campaign or redemption count. One public trial is allowed per account owner. A redirect from Checkout does not grant access; entitlement starts only after Somemind verifies the signed Stripe webhook.

5. Private complimentary access

Punasaari Research may separately issue a private complimentary Starter code that the workspace owner can activate in Billing settings. It is not a Stripe trial, does not require a card and does not renew or charge automatically. It may be converted to a paid subscription at any time.

6. Paid plans, renewal and cancellation

Prices, limits, taxes and billing intervals are shown before purchase. Paid subscriptions renew automatically until cancelled. Customers may cancel through Stripe Customer Portal; cancellation normally takes effect at the end of the current paid period. Failed payments may lead to a limited recovery period and then suspension.

• No discretionary refund programme applies to correctly charged fees.
• Mandatory law and remedies for duplicate, incorrect or unauthorized charges remain unaffected.
• The Customer must keep payment and tax information current.

7. Customer content and AI output

The Customer retains its rights in submitted content and grants Somemind a limited right to host, transform and transmit it to provide the service. AI output may be inaccurate, unsuitable, repetitive or similar to other output. Somemind does not guarantee reach, engagement, correctness or publication by a third-party platform.

8. Acceptable use

The service may not be used for unlawful, deceptive, infringing, hateful or harmful content; credential theft, malware or spam; unauthorized security testing; evasion of plan limits; or interference with Somemind or third-party platforms. We may suspend activity reasonably necessary to protect customers, providers or the service.

9. Data protection

The Privacy Policy describes controller processing. When Somemind processes personal data on the Customer’s documented instructions, the DPA 2.0 applies after workspace acceptance. Connected-platform data is used only for the authorized service functions.

10. Availability and changes

We operate the service with reasonable professional care but do not promise uninterrupted availability, an exact publication time, error-free AI or continued third-party API access. Material contractual changes are communicated where required.

11. Liability

To the maximum extent permitted by law, indirect or consequential loss is excluded and aggregate liability is limited to fees paid for the affected service during the preceding 12 months. Nothing excludes liability that cannot legally be excluded, including fraud, wilful misconduct or mandatory statutory liability.

12. Termination, law and contact

Either party may terminate as allowed by these Terms. Finnish law applies and business disputes are handled by competent Finnish courts. These clauses do not remove mandatory rights that legally apply.
